38. Is it possible to differentiate between the data recipients and apply different licensing conditions?

Article 8(3) of the Data Act implements the general principle that it is not admissible to differentiate between entities that are in the same situation (non-discrimination). Analysing whether two recipients are in a comparable category must be done on a case-by-case basis.
