44. What does the term ‘equivalent conditions’ mean in the context of [Article 15(1)](/docs/data-act/article-15#paragraph-1)(a)?

‘Under equivalent conditions’ could be read in the context of this Article as a rule requiring a public sector body wishing to use its rights under Chapter V of the Data Act to first verify whether the same data could not be obtained elsewhere, while at the same time requiring a comparable amount of effort. The last sentence of Recital 64 provides some examples in this regard.
